The Ketogenic Foundation Terms of Use

Overview

This website is operated by The Ketogenic Foundation, a California nonprofit public benefit corporation and 501(c)(3) public charity (“Foundation,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, newsletters, donation pages, educational resources, research summaries, event registration pages, and any other online services or platforms that link to or reference these Terms (collectively, the “Services”).

By accessing or using the Services, you affirmatively acknowledge and agree to be bound by these Terms and by any policies referenced herein, including our Privacy Policy.


1. Educational and Health Information Disclaimers

a. Educational and Informational Purposes Only (No Medical Advice)

The Services provide general educational and informational content related to metabolic health, ketogenic therapies, medical education, and research dissemination (the “Content”). The Content is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease.

The Foundation is not a healthcare provider, does not provide medical care, and does not create a clinician–patient relationship. Always seek the advice of a qualified, licensed healthcare professional regarding any medical condition, medications, supplements, or changes to diet, lifestyle, or treatment.

The Foundation does not employ licensed healthcare providers in a clinical capacity and does not credential, supervise, or verify the qualifications of any third-party healthcare providers, researchers, or clinicians mentioned in the Content. Any information attributed to third parties reflects their views and does not constitute endorsement by the Foundation.

b. Emergencies

The Services are not intended for use in medical emergencies. If you believe you are experiencing a medical or mental health emergency, call 911 (in the United States) or your local emergency number, or seek immediate medical care.

c. Research Dissemination and Scientific Uncertainty

The Foundation may publish, summarize, or link to scientific research, conference materials, and educational resources. Scientific knowledge evolves, and information may become outdated, incomplete, or superseded. We make no guarantees regarding accuracy, completeness, or timeliness. You agree not to rely on the Services as a substitute for professional medical judgment or individualized care.

d. No Endorsement

References to third-party research, clinicians, institutions, therapies, products, services, or organizations do not constitute endorsement unless explicitly stated.


2. Eligibility and User Responsibilities

a. Age Requirements You must be at least 13 years old to use the Services. If you are between 13 and 18, you may use the Services only with the consent and involvement of a parent or legal guardian.

b. Accurate Information

You agree to provide accurate and current information when submitting forms, making donations, registering for events, or otherwise interacting with the Services.

c. Assumption of Risk

Educational content related to health, nutrition, and medicine may involve risk if applied without appropriate professional oversight. You assume all risks associated with actions you take based on the Services or Content, to the fullest extent permitted by law.


3. Prohibited Uses

You agree not to, and not to assist others to:

  • Use the Services in violation of applicable law or regulation
  • Misrepresent your identity or affiliation
  • Harass, threaten, defame, abuse, or discriminate against others
  • Upload or transmit malware, or attempt to disrupt or compromise the security or functionality of the Services
  • Promote dangerous, deceptive, or misleading health claims, including encouraging others to disregard professional medical advice
  • Copy, reproduce, distribute, or exploit Content for commercial purposes without prior written permission

The Foundation may suspend or terminate access for violations or suspected violations of these Terms.


4. Intellectual Property

a. Foundation Content

Unless otherwise noted, the Services and all Content are owned by or licensed to the Foundation and are protected by copyright, trademark, and other applicable laws.

You may view, download, and print Content solely for personal, non-commercial educational use, provided that all copyright and proprietary notices are retained and the Content is not modified.

b. Trademarks

The “Ketogenic Foundation,” its name, logos, and related marks are trademarks or service marks of the Foundation and may not be used without prior written permission.



5. User Submissions (If Applicable)

Some Services may allow you to submit content, including comments, messages, stories, testimonials, photos, or event-related materials (“User Content”).

Do not include protected health information (PHI), personal medical information, or any information subject to privacy laws (such as HIPAA) in User Content. User Content may be publicly visible, is not treated as confidential, and should not contain sensitive personal information. You are solely responsible for any personal or health information you choose to share through the Services.

a. Your Responsibility

You represent and warrant that you have all necessary rights to submit User Content and that it does not violate applicable law or infringe third-party rights. User Content submitted through the Services may be viewed, shared, or used as described in these Terms and should not be submitted with an expectation of confidentiality.

b. License Granted to the Foundation

By submitting User Content, you grant the Foundation a non-exclusive, royalty-free, worldwide licenseto use, reproduce, display, distribute, and create derivative works from such User Content for nonprofit purposes consistent with the Foundation’s mission, including education, awareness, research dissemination, fundraising communications, and program delivery.

c. Removal

The Foundation may remove or restrict access to User Content at any time, for any reason, including if it believes the Content violates these Terms.



6. Donations and Tax Matters

a. Donations

Donations to the Foundation are voluntary and support its charitable mission. Unless required by law, donations are non-refundable.

b. Tax Deductibility

The Foundation is a 501(c)(3) public charity. Donations may be tax-deductible to the extent permitted by law. The Foundation does not provide legal or tax advice; donors should consult their own advisors. Donation acknowledgments will be provided in accordance with legal requirements.

c. Restricted Gifts

If you make a donation designated for a specific program or purpose, the Foundation will make good-faith efforts to honor your intent. However, if a restriction becomes impracticable, inconsistent with the Foundation’s mission, or otherwise not feasible, the Foundation may redirect the gift as permitted by law. All donations are accepted subject to the Foundation’s charitable mission and compliance with applicable law and do not create any contractual rights or obligations beyond those expressly stated in these Terms. Donations do not create a fiduciary, advisory, or trustee relationship between the donor and the Foundation beyond the Foundation’s obligations under applicable nonprofit law.


7. Events, Programs, and Educational Offerings

The Foundation may offer webinars, conferences, symposia, courses, workshops, or other educational programs (“Programs”).

a. Additional Terms and Policies

Additional terms may apply to specific Programs, including codes of conduct, cancellation and refund policies, continuing education credit requirements, technical requirements for virtual events, and recording policies. Such additional terms will be disclosed at the time of registration or in Program materials and are incorporated into these Terms by reference.

b. Cancellations and Refunds

Program registration fees, if any, are subject to the cancellation and refund policy disclosed at registration. The Foundation reserves the right to cancel, reschedule, or modify any Program due to insufficient enrollment, speaker availability, force majeure, or other circumstances. In the event of cancellation by the Foundation, registered participants will be offered a refund or credit toward a future Program, as disclosed in the applicable Program terms.

c. Recording and Photography

Programs may be photographed, recorded, or livestreamed. By participating in a Program, you consent to the Foundation’s recording, photographing, and use of your name, voice, image, and likeness in connection with the Program for educational, promotional, and archival purposes consistent with the Foundation’s nonprofit mission. If you do not wish to be recorded or photographed, please notify us in advance at support@ketogenicfoundation.org, and we will make reasonable accommodations where feasible.

d. Virtual Event Requirements

Virtual Programs may require specific software, hardware, internet connectivity, or platform accounts (e.g., Zoom, Microsoft Teams). You are responsible for ensuring you have the necessary technical requirements. The Foundation is not responsible for technical issues that prevent your participation.

e. Continuing Education Credits

If continuing education credits (CME, CNE, CPE, or similar) are offered, specific attendance, participation, and evaluation requirements may apply. The Foundation makes no guarantee that credits will be accepted by any licensing board or certifying body. It is your responsibility to verify whether credits meet your professional requirements.


8. Third-Party Links and Resources

The Services may contain links to third-party websites or resources. The Foundation does not control and is not responsible for third-party content, accuracy, availability, or privacy practices. Use of third-party resources is at your own risk.


9. Privacy and Data Protection

a. Privacy Policy

The Foundation’s collection and use of personal information are governed by its Privacy Policy, which is incorporated into these Terms by reference and available at ketogenicfoundation.org/privacy.

b. Cookies and Tracking Technologies

The Services use cookies, web beacons, analytics tools, and similar tracking technologies to improve functionality, analyze usage, and personalize content. By using the Services, you consent to our use of these technologies as described in our Privacy Policy. You may manage cookie preferences through your browser settings, though disabling cookies may limit your ability to use certain features of the Services.

c. California Privacy Rights

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion of your personal information, and the right to opt out of the sale of personal information (though the Foundation does not sell personal information). d. International Users

If you access the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Services, you consent to the transfer of your information to the United States.

e. Email Communications and Unsubscribe Rights

By providing your email address through the Services, you may receive newsletters, educational updates, donation appeals, event notifications, and other communications from the Foundation. All marketing emails will include an unsubscribe mechanism. You may opt out of marketing communications at any time by using the unsubscribe link in our emails, updating your preferences in your account (if applicable), or contacting us at support@ketogenicfoundation.org. Please note that even if you opt out of marketing emails, we may still send you transactional or administrative messages related to your use of the Services, donations, or event registrations.


10. Copyright Infringement (DMCA)

If you believe Content on the Services infringes your copyright, please send a DMCA notice to info@ketogenicfoundation.org with the subject line “DMCA Notice,” including all information required under 17 U.S.C. §512.


11. Disclaimer of Warranties

To the maximum extent permitted by law, the Services and Content are provided “AS IS”and“AS AVAILABLE”, without warranties of any kind, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, or non-infringement. The Foundation does not warrant uninterrupted, secure, or error-free operation.


12. Limitation of Liability

To the maximum extent permitted by law, the Foundation and its directors, officers, employees, volunteers, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of, or reliance on, the Services or Content.

If liability cannot be excluded, the Foundation’s total liability shall not exceed the amount you paid to the Foundation, if any, in the six (6) months preceding the event giving rise to the claim.


13. Indemnification

You agree to indemnify and hold harmless the Foundation from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.


14. Termination

The Foundation may suspend or terminate access to the Services at any time if it reasonably believes you have violated these Terms or pose a risk to the Services or others. Provisions that by their nature should survive termination shall survive.


15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Napa County, California, except where prohibited by law.


16. Dispute Resolution and Class Action Waiver

a. Informal Resolution

Before filing any claim or lawsuit, you agree to first contact the Foundation at support@ketogenicfoundation.org to attempt to resolve the dispute informally. The Foundation will attempt to resolve disputes in good faith through negotiation within thirty (30) days of receiving notice of the dispute.

b. Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute with the Foundation will be resolved on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate as a class member or representative in any class or representative proceeding.

c. Exceptions to Arbitration

Either party may bring an individual action in small claims court if the claim qualifies. Additionally, either party may seek injunctive or equitable relief in court to protect intellectual property rights or prevent harm.


17. Changes to These Terms

The Foundation may update these Terms from time to time. The “Last Updated” date reflects the effective date. Continued use of the Services after changes constitutes acceptance of the revised Terms.


18. Accessibility

The Foundation is committed to ensuring that the Services are accessible to individuals with disabilities. We strive to comply with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards and applicable accessibility laws, including the Americans with Disabilities Act (ADA).

If you experience difficulty accessing any part of the Services or require accommodation to participate in our Programs or access our Content, please contact us at support@ketogenicfoundation.org. We will work with you to provide the information or services you seek through an alternative communication method or reasonable accommodation consistent with applicable law.


19. Force Majeure

The Foundation shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, labor disputes, government actions or orders, utility failures, internet or telecommunications failures, or other similar events (each, a “Force Majeure Event”). In the event of a Force Majeure Event, the Foundation’s obligations shall be suspended for the duration of the event, and the Foundation will use reasonable efforts to resume performance as soon as practicable. If a Force Majeure Event prevents the Foundation from delivering a Program or service for which you have paid, the Foundation will offer a refund, credit, or alternative arrangement as described in the applicable Program terms or as otherwise determined by the Foundation in its reasonable discretion.


20. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, which shall remain in full force and effect.


21. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms or policies referenced herein or disclosed at the point of service (such as event-specific terms, donation acknowledgments, or program policies), constitute the entire agreement between you and the Foundation regarding your use of the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Services.


22. Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. The Foundation’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by the Foundation.
